Re: India By Law

Dear citizen of the world,

Rather than blaming the system, we (myself and Dr. Versha Vahini, Prof. NLSIU Bangalore, India) have taken unto ourselves to do our bit for much needed renaissance of our country i.e. India. Friends, kindly like/share/promote the initiative, after visiting the following link. This is just a beginning...

An Open Letter to Mr. Justice J. S. Verma Even as you lordship’s suggestion box must have been deluged with several suggestions by “we, the people”, some of the following issues need equal consideration: The Justice Delivery Mechanism begins with Public Servants and Judges hence there is an urgent need to revisit Section 197 of Code of Criminal Procedure, 1908 in the light of Nuremberg principle. The Nuremberg principle be applied in India, as other principles of law and international treaties have been applied in cases such as Nilbati Behera by your Lordship. This would help the courts fasten liabilities upon individual Police officials for their acts in incidents such as public protests and handling of several cases which they otherwise do in the course of their service. Secondly, since everyone would be conscious of Damocles sword they would act more responsibly towards the citizens in general and other normal circumstances. This would also help in Police Reforms in so far as in the long run it will get the Police System rid of Shrimaan Saahab Bahadur system of feudalism prevalent within their own organization. Need of the hour is to have policing system like Israel. Since the Executive and Legislature have failed and shall not, for political reasons, devise and implement such laws, this can come only through such an activism on the part of the Judiciary. Let every Police official be ordered to address the member of the public as Sir. Automatically, the public would also address them as Sir or Officer. After all, respect begets respect. This would help bridge the confidence and trust deficit between the public at large and police. Let there be transparency in the conduct of trial. They need not disclose the case diary in so far as Investigation Process is concerned. Information such as action taken by the Police before the registration of FIR, at the stage of registration of FIR, after the registration of FIR however be made transparent. There should be CCTV cameras at the Duty Rooms to keep a watch over the actions of the Police personnel responsible for registration of FIRs. That is the first stage where a victim/complainant is denied redressal of his grievance. Let the conduct of the Duty Room officials be made accountable. At the same time, an Action Taken Report be submitted to a Senior Police Official through proper channel, after each and every dial of 100, after attending to the complainant or caller and getting his signature of having attended to him. After taking care of this first step towards taking cognizance of the case, a time bound approach be adopted to complete the investigation. Only some such matters which are very complex in nature require 90 days to investigate. This time limit fixed by the law, therefore be checked and the Investigation Officers be asked to submit a work-done sheet with proper explanations of each single day’s work in a case. Once the matter goes to the Court, even there, a time limit be fixed for completion of a case, be it framing of charges or trial. This would require recruiting more number of officials in the Judicial System, so let that be done. We require good Judicial Academies across the nation, which are functional in true sense. There should be some kind of a rigorous examination system at these Judicial Academies where the candidates should succeed based on their merits and not reservation. Last but certainly not the least, resources need to be properly allocated for recruitment of more police force for security of the non-VIPs i.e. We, the people (also), since we are the only people who matter to the entire criminal justice system and we are the only people to whom the criminal justice system matters too. Dawn of Independence

As another Independence day approaches in this corrupt land one can't help but think that Nehru enjoyed his own "Trysts" and "We, The People" suffer our Tryst with the destiny...

Blame Game and Aam Aadmi

Argument of Pari Delicto essentially involves admission of guilt (as well); PM sees skeletons in the opposition’s cupboard. R K Laxman’s common man is being reduced to skeleton…

Lokpal Bill & Syllogism

Major Premise: Any Indian citizen, if corrupt, may have to face CBI and Prevention of Corruption Act, 1988.
Minor Premise: Prime Minister and Judges of Supreme Court have to be Indian Citizens.
Conclusion: Argument of UPA and Jayalalitha is a non-starter.

NLIU Alumni Body as a family

I've perused the draft and I am happy to see the Macaulays being produced from my alma mater. Well, do you need any more comments on the draft.

Secondly or perhaps the most important pillar of any successful Alumni Body is... interaction and bonhomie amongst alumni, which a draft statute may (or may not) generate. Even as the draft is fine, we need to work on its preamble, purpose and objectives. I was blessed to have studied at a great school with a great alumni body and hence I would be very happy to share my experience from there so that the Law School where I was fortunate to be in the first batch and where I could see the University growing from almost a scratch (I remember even the roads in that Agricultural Deptt. Building were being made and there were bulldozers, road rollers and water tankers when I had stepped in the then Campus!!!)

Having said that, as a first step, I would suggest that we work on "developing" chapters as has been suggested in the draft as well. Secondly, members in these chapters should organize meetups. We may not like lectures, debates etc. in such meetups for all the time that's what we do. Lets just meet, mingle, share our happiness (and problems too!!!). Lets try converting this Alumni Association into a family...

God speed!!!

Appeal to NLIU Alumni

Dear Friends,
In my professional journey, I have been meeting several people with various educational backgrounds including lawyers who are pass outs of National Law School system. I observed that many of them who are doing well in their career and lives owe their suceess to their alma mater and are thus very well networked. To quote ...an example: the ex-student body of my school is so very well networked that we feel like being a part of the extended family where we help each other not only in the career but even during any kind of distress--medical exigencies or financial distress etc... I was surprised to see that IIM A even had a matrimony site where they would seek the matrimonial alliance within the IIMs only, for all the others are considered as someone with lesser intelligence and not a suitable alliance. Well, though bachelor but that is not my intent behind writing this messsage to you!!!
I am in touch with many ex-students of our Law School. Some of them have at times discussed with me about some placements opportunity or for change or for some referrals etc. I remember Ms. Jayne Kuriakose of 2nd batch had started an egroup in yahoo, but I don’t see any activity on the egroup. I would strongly suggest that we should be connected on some egroup or may be we could revive the activities in that egroup where we could help each other in their quest for a good career or any other kind of help which one could do. Popular platforms like FB could also be used for this purpose. Even NLS Bangalore has a very nicely networked ex-students body, I think this is the time where those who are nicely placed and doing good or whosoever is capable of helping others should come forward and help others. Or lets stay connected just like that and enjoy golf, get together and party after working hard…!!!
